The Chef Metropolitan Magistrate Court (CMM), Dhaka issued warrants for arrest of four police officers, including former Ramna police officer-in-charge Mahbubur Rahman on Wednesday September 22, 2010, t in connection with torturing a Chhatra League leader in custody to force ‘false admission’ in the case of attempt on the life of Dhaka University teacher Humayun Azad in2004.
Metropolitan Magistrate Mehedi Hasan Talukder passed the order after hearing an investigation report on a complaint filed with the Dhaka Chief Metropolitan Magistrate’s Court on March 5, 2008 by Chhatra League leader Abu Abbas Bhuiyan accusing former state minister for home affairs Lutfozzaman Babar and the four policemen of torturing him in custody to force ‘false.
Advocate Shahanur Islam on behalf of the Bangladesh Institute of Human Rights (BIHR) under the project of JusticeMakers Fellowship 2010 represented Abbas during the hearing.
The court also asked the serving Ramna police officer-in-charge Shibli Noman to report to the court on October 26 on the execution of the warrants against the former officer-in-charge Mahbub, now on suspension, subinspectors Rezaul Karim, now posted to the Pabna Kotwali station, and Naser Ali, posted to the Special Branch (Dhaka city), and sergeant Anwar Hossain, now posted to the Jatrabari police.
‘The four policemen have committed offences under Section 330, 331 and 34 of the penal code by physically torturing Abbas at the Ramana police station in the period between February 28, 2004 and March 3, 2004 in the name of extracting confession from him,’ said the investigation report filed on August 19 by CID inspector Ehsan Uddin Chowdhury.
It is learned that a gang of miscreants attacked Prof Humayun Azad in front of Bangla Academy when he was on his way back home on February 27, 2004 leaving him seriously injured. Later on February 28, police arrested Mohammad Abu Abbas Bhuiyan, Mass Education Affairs' secretary of Bangladesh Chhatra League central committee for attacking Humayun Azad.
Later, he was remanded and taken to Ramna police station where the police tortured him for giving confessional statement. But police pressed charges against Jama'atul Mujahedin Bangladesh members in the case while dropping Abbas' name from the charge sheet on November 15 of 2007 after a probe.
After getting bail from the court, Abbas, also a student of Political Science of Dhaka University, filed the case with the Dhaka Chief Metropolitan Magistrate's Court on March 5 of 2008 accusing Babar, Mahbubur Rahman and three other police officials for torturing with the legal assistant of JusticeMakers Bangladesh.
After the hearing, the court directed detective branch (DB) of police to submit a report after an investigation. But Detective Branch inspector Abul Kalam Chowdhury on June 14, 2008 submitted an investigation report on Abbas’s complaint saying it was ‘false’ as no incident of torturing had taken place.
Metropolitan magistrate Faisal Atiq bin Kader on July 23, 2009 ordered further inquiry of the complaint by a special superintendent of the Criminal Investigation Department as Abbas’s lawyer had submitted a petition expressing ‘no confidence’ in the report.

অভিযোগে জানা যায়, গত ২৭ ফেব্রয়ারী ২০০৪ ইং তারিখে ঢাকা বিশ্ববিদ্যালয়ের
বাংলা বিভাগের সম্মানিত শিক্ষক ডঃ হুমায়ূন আজাদের উপর সন্ত্রাসীদের হামলার
প্রতিবাদে গত ২৮ ফেব্রুয়ারী ২০০৪ ইং তারিখে ঢাকা বিশ্ব বিদ্যালয়ের সাধারণ
ছাত্র-ছাত্রীদের ব্যানারে অনুষ্ঠিত মিছিল হতে ঢাকা বিশ্ববিদ্যালয়ে
রাষ্ট্রবিজ্ঞান বিভাগের ছাত্র ও বাংলাদেশ ছাত্রলীগ কেন্দ্রীয় নির্বাহী
সংসদের গণশিক্ষা বিষয়ক সম্পাদক মোঃ আবু আব্বাস ভুঁইয়াকে গ্রেফতার করে রমনা
থানা্য় আটকনির্মম নির্যাতন করে। পরবর্তীতে ডঃ হুমায়ূন আজাদের উপর সন্ত্রাসী
হামলা্য় মিথ্যেভাবে জড়িত করে ৫ দিনের রিমান্ডে নিয়ে স্বীকারোক্তি আদায়ের
নামে গত ০২ মার্চ ২০০৪ তারিখ পর্যন্ত রমনা থানার তৎকালীন ভারপ্রাপ্ত
কর্মকর্তা মাহবুবুর রহমানসহ উল্লেখিত পুলিশ সদস্যগন অমানবিক নির্যাতন করে
তার বাম হাতের মধ্যাঙ্গুল ভেঙ্গে ফেলে। পরবর্তীতে তার অবস্থা খুব বেশী
খারাপ হলে জেল হাজতে প্রেরণ করেন।
পরবর্তীতে, তিনি উক্ত মামলা থেকে বেখুশুর খালাশ পেলে মানবাধিকার প্রতিষ্ঠান বাংলাদেশ ইন্সটিটিউট অব হিউম্যান রাইটস্ (বিআইএইচআর)
এর অইনগত সহযোগিতায় নির্যাতিত ছাত্রলীগ নেতা মোঃ আবু আব্বাস ভুঁইয়া গত
২০০৮ সালের ০৫ মার্চ ইং তারিখে ঢাকা বিজ্ঞ মুখ্য মহানগর হাকিমের আদালতে
দন্ডবিধির ৩২৩/ ৩২৪/ ৩২৫/ ৩২৬/ ৫০৭/ ৩৭৯/ ৫০০/ ১০৯/ ৩৪ ধারায় একটি মামলা
দায়ের করেন। অতিরিক্ত মহানগর মূখ্য হাকিম মোঃ এমরান হোসেন চৌধুরী বাদীর
জবানবন্দী গ্রহন করে ডিসি ডিবিকে ঘটনাটি তদন্তপূর্বক রিপোর্ট প্রদানের
নির্দেশ দেন।
কিন্তু
মামলার তদন্ত কর্মকর্তা আবুল কালাম চৌধুরী আসামী পক্ষের দ্বারা প্রভাবিত
হয়ে গত ১৪ জুন ২০০৮ ইং তারিখে একটি মনগড়া, ফরমায়েশি, পক্ষপাতমূলক প্রতিবেদন
আদালতে দাখিল করলে উক্ত প্রতিবেদনের বিরুদ্ধে বাদী মহানগর মূখ্য হাকিমের
আদালতে একটি নারাজি আবেদন দাখিল করেন। মহানগর হাকিম ফয়সাল আতিক বিন কাদের
গত ২৩ জুলাই ২০০৯ তারিখে পূনরায় বাদীর জবানবন্দি গ্রহণ করে গত ২৬ জুলাই
২০০৯ ইং তারিখে ঘটনাটি পূনরায় তদন্তের জন্য এসএসপি, সিআইডি, ঢাকাকে আদেশ
প্রদান করেন।
দীর্ঘ
এক বছর তদন্ত শেষে ঢাকা মহানগর গোয়েন্দা পুলিশ এহসান উদ্দীন চৌধুরী গত ১৮
সেপ্টম্বর ২০১০ ইং তারিখে দন্ড বিধির ৩৩০/৩৩১/৩৪ ধারা্য উল্লেখিত আসামীদের
অভিযুক্ত করে একটি প্রতিবেদন দাখিল করেন। উক্ত প্রতিবেদনের উপর বাদী পক্ষের
শুনানী শেষে বিজ্ঞ আদালত অবিযোগটি আমলে নিয়ে উপরোক্ত আসামীদের বিরুদ্ধে
গ্রেফতারী পরোয়ানা জারী করেন।
